The terms and conditions contained herein (hereinafter “Terms of Use”) govern the use of triumphpropertymanagement.com (hereinafter “Website”), which is furnished by Triumph Property Management Corporation (hereinafter “TPMC”). By accessing the Website in any manner, including by perusing its content, clicking on elements thereon or submitting information through it, you agree to be bound by the Terms of Use, which may be updated from time to time. If you do not agree to the Terms of Use, you are not authorized to use or access the Website.

Scope of Services through the use of the Website

Through your use of the Website, including but not limited to accessing its content and submitting information through it, TPMC does not thereby (i) act as a real estate agent for you or any other person or entity, (ii) represent you or any other person or entity in the sale, purchase, lease, transfer or exchange of any real property, (iii) rent, purchase, sell, transfer, lease any real property or otherwise assist in the rent, purchase, sale, transfer or lease of any real property, (iv) agree to provide or provide real estate advice or (v) agree to become or actually become your agent, real estate agent or real estate broker, nor do you become a client of TPMC.

By furnishing the Website, TPMC assumes no responsibility for any actions, inactions or decisions you may make based on the information contained on the Website, including but not limited to your reliance on any content contained on the Website or through your submission of any information through the Website and TPMC hereby expressly discourages your reliance on the Website for any purpose, including but not limited to any transactions concerning real property.

Warranties

TPMC provides the Website on an “as is” basis. To the maximum extent provided by applicable law, TPMC makes no representations or warranties, either express or implied and TPMC hereby disclaims any and all warranties, including any statutory warranties. You access the Website at your own risk.

Requirements

By accessing the Website, you warrant that (i) you are at least 18 years of age, (ii) any information you submit through the Website is of your own volition and that you are authorized to submit the information you have submitted and (iii) by submitting any information through the Website, you authorize TPMC to contact you by telephone, e-mail, SMS text message and through any other method of contact you have provided in order to discuss your submission of information through the Website.

By accessing the Website, you agree not to utilize the Website or its contents for any unlawful purpose or allow or encourage or attempt to allow or encourage a third-party from utilizing the Website or its contents for any unlawful purpose.

TPMC assumes no responsibility for any internet links or references to third-party websites, companies or services, including the content contained on any such external website or the services they may provide. TPMC is not responsible for, nor does it endorse any content, products or services available through any third-party websites or companies and does not make any representations regarding their content or the quality of the services they provide.

Indemnification

You agree to indemnify, defend and hold harmless TPMC, its directors, officers, employees and agents from any and all claims, rights, lawsuits, demands, actions, obligations, liabilities, losses and causes of action, including without limitation, injury to persons, property or death and reasonable attorney fees arising out of (i) your access to or your use of the Website, (ii) your breach of the Terms of Use, (iii) your violation of any laws, statutes, regulations or ordinances, (iv) any dispute, claims, lawsuits or demands between you and any third-party that may implicate TPMC and (v) your submission of any information through the Website.

TPMC reserves the right to select and appoint its own counsel for the defense of any such matters specified above, at your reasonable expense. TPMC also reserves the right to assume the exclusive defense and control of any matter subject to your indemnification, as specified above, at your reasonable expense.

To the fullest extent permitted by law, you hereby waive and release TPMC from any and all claims, rights, lawsuits, demands, actions, obligations, liabilities, causes of action, losses and damages arising out of your use of the Website.

Choice of Law

The Terms of Use are governed by the laws of the State of Nevada. You agree to submit to the jurisdiction of Nevada for any dispute arising out of your use or access of the Website. Except as otherwise provided herein, in the event that any condition and/or covenant herein contained is held to be invalid or void by any Court of competent jurisdiction, the same shall be deemed severable from the remainder of the Terms of Use and shall in no way affect any other covenant or condition herein contained. If such condition, covenant or other provision shall be deemed invalid due to scope or breadth, such provision shall be deemed valid to the extent of the scope or breadth permitted by law.

Consent to Communications

By accessing the Website, including submitting information through it, you agree to consent to receive communications, including electronic communications, text messages, SMS messages and telephone calls from TPMC, and as further specified in the Privacy Policy.

Rental Applications, Owner Portal, Tenant Portal

TPMC works with appfolio, a third-party website in order to process online rental applications and provide residential services such as rental payment processing and processing of other payments such as application fees by prospective tenants (hereinafter collectively “Prospective Client and Existing Client Services”). Prospective Client and Existing Client Services are integrated into TPMC’s Website and appear that the services are being provided through TPMC’s Website when users are actually accessing a third-party website. For instance, while the Prospective Client and Existing Client Services webpages may appear like you are browsing TPMC’s Website, the URL listed in your browser may not be the Website, which demonstrate that you are accessing a third-party website and that any information you provide will be subject to the third-party’s terms and conditions and privacy policy, which you can access here. TPMC is not responsible for ensuring the functionality and availability of third-party websites, including Prospective Client and Existing Client Services, through which online rental applications, application fee payment processing and other residential services such as rental payment processing may be handled. If the third-party portal for online rental payment processing is unavailable, an existing client should use an alternative method for payment. Similarly, if online rental application submissions and/or application fee payment processing are unavailable, you should contact TPMC in order to discuss the possibility of alternative-submission options.We do not accept Section 8

BY ACCESSING THE PROSPECTIVE CLIENT AND EXISTING CLIENT SERVICES WEBPAGES OR BY CREATING A USER ACCOUNT IN ORDER TO ACCESS THE PROSPECTIVE CLIENT AND EXISTING CLIENT SERVICES, YOU THEREBY AGREE TO THE TERMS OF USE AND PRIVACY POLICY LOCATED AT THE LINK ABOVE.
